Insurer’s keep the first $30,000 of your damages!

In Ontario, if someone hurts you using a motor vehicle, the insurance company will get to keep $30,000 of your damages. As an innocent victim of a car accident who has suffered injuries, you have the right to sue the other driver who caused the accident. What you may not know is that your damages for your pain and suffering will almost certainly be reduced by $30,000. It is a little-known fact that there is a $30,000 deductible on pain and suffering damages for almost all motor vehicle accident victims.

The only exception is for the most serious cases where your pain and suffering damages are more than $100,000. However, in Ontario, only the most serious cases ever exceed this amount, likely less than 10 percent of all cases. As an example, if a jury of your peers awards you $50,000 for your pain and suffering for your injuries, the insurance company representing the defendant who hurt you only has to pay $20,000.

There is no disputing that this is an unfair burden on innocent victims of car accidents. In order to minimize the impact of this unfair deductible on pain and suffering, you need to maximize your damages. Your best bet is to hire experienced lawyers to represent you to ensure that you are getting fair compensation for your injuries.
